Year: 2026
Type: article
Study design: Systematic Review
Abstract: This article analyzes the centrality of the social worker's professional confidentiality within the scope of the Judiciary, contextualizing it as a supporting pillar of the category's Ethical-Political Project. The general objective was to discuss the tensions between the ethical duty of confidentiality and institutional requests for procedural transparency, especially in light of the transformations brought about by the digitalization of the justice system. Methodologically, a qualitative research of a systematic bibliographic nature was carried out, with data collection conducted between October 2025 and February 2026 in the SciELO, CAPES, and CFESS databases. The results reveal that confidentiality acts as an indispensable technical instrument for building a bond of trust and for the reliability of the social study. The discussion points out that the preparation of social reports and expert opinions requires ethical selectivity on the part of the professional, functioning as a filter against the stigmatization of users. It is concluded that, in the era of the Electronic Judicial Process (PJE), the preservation of privacy reaffirms the role of the social worker as an ethical mediator, ensuring that technological modernization does not override the humanization of care and the protection of the fundamental rights of the families served.
