Imparcialidade Em Foco: Dilemas Éticos E Desafios Da Prática Do Assistente Social No Sistema De Justiça

Type: article
Abstract: This article analyzes the ethical dilemmas and the challenges inherent in the pursuit of impartiality within the practice of social workers operating in the Justice System. Forensic expertise in this context demands a methodological rigor that transcends the persistent myth of neutrality, positioning impartiality not as an absence of stance, but as a technical commitment to the accuracy of social facts and the uncompromising defense of human rights. Through qualitative research, characterized by a bibliographic and systematic approach, this study investigates how individual preconceptions and institutional moralism can compromise technical exemption and the quality of professional work. The findings indicate that technical autonomy constitutes the primary bulwark against the productivist pressures of the Judiciary and the historical tendency toward the criminalization of poverty and the expressions of the "social question." It is concluded that critical impartiality, grounded in the principles of the category's Ethical-Political Project, is indispensable to ensuring that social forensic work functions as an effective instrument for the realization of rights and justice. This approach prevents the professional from becoming a mere agent of social control and a reproducer of inequalities within the legal sphere.
