Abstract: This study investigates cyberspace as a criminogenic vector, analyzing the impact of virtual hate communities on youth radicalization and the adequacy of the Brazilian Internet Bill of Rights (Law No. 12,965/14). The general objective is to evaluate whether the civil liability regime for digital platforms provided for in Article 19 contributes to the spread of such speeches due to its procedural delays. Under the perspective of Edwin Sutherland's Differential Association Theory, combined with Cass Sunstein's concepts of echo chambers and Eli Pariser's invisible filters, the theoretical framework demonstrates that algorithms enhance the learning of deviant behaviors and extreme polarization. The methodology consisted of a qualitative bibliographical and documentary research. The results reveal a direct correlation between the unregulated digital environment and the increase in extreme violence attacks on schools in Brazil, showing that the judicialized 'notice and take down' model is obsolete against algorithmic dynamics. It is concluded that combating online hate speech has a solid constitutional basis in human dignity, as established in the Ellwanger Case, justifying the need for legislative reform to impose a proactive duty of care on platforms, aligned with the European Digital Services Act.
