From birth certificate to altar: legal implications of gender change for Anglican marriage in Australia
Year: 2026
Type: article
Abstract: This article analyses the intersection between secular and ecclesiastical law in the recognition of gender and marriage within the Anglican Church of Australia (ACA). It traces the development of Australian legislation from medical-certificate to affirmation-based models of gender recognition and examines how these legal changes intersect with the ACA’s canonical understanding of marriage as a union between a man and a woman. Drawing on doctrinal sources, statutory interpretation, and comparative analysis, the article considers the reasoning of the Wangaratta Appellate Tribunal decision and subsequent diocesan responses to transgender clergy. It argues that, while the ACA’s doctrine of marriage is broadly settled, it remains unclear whether the terms ‘man’ and ‘woman’ are to be understood as a person’s sex assigned at birth or by reference to legally recognised sex. This doctrinal ambiguity creates practical uncertainty for clergy and couples, underscoring the need for clearer theological, canonical, and pastoral guidance.
