The Lag of Justice Theory: Temporal Delay as the Essence of Human Judgment

Year: 2026
Type: preprint
Abstract: This paper presents the Lag of Justice Theory, He Yi's radical proposition that the essential attribute of justice is not speed, fairness, or consistency but "lag"—the necessary temporal delay between action and judgment that allows for complexity, context, and human mercy to enter the evaluative process. He Yi argues that algorithmic instant judgment (speed trials, automated sentencing, social media shaming) destroys this essential lag, thereby destroying justice itself. The theory has profound implications for legal reform, platform governance, and AI ethics.
