Enforcement Without Adversarial Review
Year: 2026
Type: preprint
Abstract: This independent legal study examines the transition from a disputed claim to judicial enforcement and the procedural safeguards required before coercive enforcement measures may produce irreversible consequences. The analysis focuses on effective judicial protection, adversarial proceedings, access to justice, proportionality, procedural fairness and the obligation to provide an effective remedy. Particular attention is given to situations in which enforcement proceeds despite unresolved objections or where procedural mechanisms fail to provide meaningful review before irreversible harm occurs. The study assesses these issues in the context of Article 47 of the Charter of Fundamental Rights of the European Union, Article 6 and Article 13 of the European Convention on Human Rights, and Article 92 of the Constitution of the Republic of Latvia (Satversme). The publication is based on documented procedural materials and is intended to contribute to independent legal and rule-of-law analysis concerning the effectiveness of judicial protection in enforcement proceedings.
