This study aims to clarify the nature of the obligation to inform of the risks associated with medical waste, its legal characterization, and the regulatory provisions governing it, in light of the Unified System for the Healthcare Waste Management in the GCC States and its Implementing Regulations, in addition to the general rules of civil liability under the Saudi Civil Transactions Law. The research problem revolves around the extent to which the provisions of the Unified System for the Healthcare Waste Management in the GCC States and its Implementing Regulations in the Kingdom of Saudi Arabia are sufficient to ensure the effectiveness of the obligation to inform of the risks of medical waste, as well as the adequacy of the rules of civil liability under Saudi law in addressing the consequences arising from this obligation, along with a number of subsidiary questions related to the nature and legal characterization of this obligation. In doing so, the study adopts a theoretical and analytical methodology. The study is divided into three sections: the first examines the nature of the obligation to inform of the risks of medical waste; the second addresses the scope and legal characterization of this obligation; and the third examines the civil liability arising from the breach of this obligation and the scope of compensation thereof. The study concludes that the obligation to inform of the risks of medical waste has a dual nature, depending on the subject matter of the obligation. It further finds that determining the party liable for compensation, in cases involving multiple actors, depends on the extent to which each party has complied with their statutory and contractual obligations, as well as the degree of their contribution to the occurrence of harm. Among the study’s recommendations is to have an explicit provision, within the Unified System for the Healthcare Waste Management in the GCC States, for imposing liability on establishments involved in the generation, transportation, or treatment of such waste for compensating damages caused to third parties as a result of breaching regulatory obligations—foremost among them the obligation to inform. The study also recommends requiring all parties involved in the stages of medical waste management to obtain mandatory insurance coverage against civil liability arising from damages caused by such waste, thereby enhancing the ability of affected parties to obtain full compensation for harm suffered.
