Type: article
Abstract: Securitization is a commercial contract that has occupied and continues to occupy great importance in countries around the world. The United States of America is considered the cradle of this new type of contract, and it was later followed by other countries around the world. It is considered one of the new contracts that was able to save most countries from the two most important problems that the global economy suffers from, namely debt distress and the problem of cash liquidity, as it was able to overcome these problems in the United States of America, Mexico and Egypt. If it is embraced in Iraq, it will contribute to solving the debt problems it suffers from, especially after the accumulation of debts from the war on Kuwait until now in 2014. The lack of cash liquidity, whether at the international or external level, has played a major role in exacerbating the debt problem. The securitization contract, like any other contract, is not concluded unless its pillars are present, and the most important pillars of the contract are the contracting parties. Do the parties to the securitization contract differ from other contracts due to the characteristics it enjoys, and can this contract be applied to our legal environment?
