Abstract: The Turkish Notarial System and the Protection of Foreign Nationals’ Legal Rights: Competence, Evidence, Liability and Comparative Perspectives This article analyzes the Turkish notarial system as an institution of preventive legal protection for foreign nationals. Using doctrinal analysis of Notaries Law No. 1512, the Code of Civil Procedure, a published Court of Cassation judgment and the Constitutional Court’s 2025/276 ruling, it distinguishes the evidentiary effects of different notarization procedures from the substantive validity of legal transactions. Particular attention is given to powers of attorney, sworn interpretation, identity verification, access for international protection applicants, and real-estate transactions. A limited comparison with French and Syrian legislation contextualizes the Turkish model. The analysis finds that notarization enhances documentary reliability but does not independently eliminate fraud, information asymmetries or defects of consent. The article recommends multilingual guidance, clearer explanation of broad mandates, transparent fees and improved access to independent legal advice. The study is doctrinal and makes no empirical claims about the prevalence of obstacles among foreign nationals. Keywords: Turkish notarial law; foreign nationals; legal certainty; evidentiary value; sworn interpreter; power of attorney; notarial liability; access to justice.
