Violencia digital contra las mujeres en América Latina: una revisión narrativa de los desafíos jurídicos y el acceso a la justicia
Year: 2026
Type: article
Abstract: Digital violence against women raises legal challenges that extend beyond criminalization and affect protection, investigation, and reparation. This narrative review examines its manifestations, selected regulatory responses, and barriers to access to justice in Latin America. A targeted documentary search covered scientific literature, specialized reports, and primary legal sources, prioritizing publications from 2020 to 2026 while retaining foundational contributions. Thirty-six references were integrated through thematic synthesis informed by gender and human rights perspectives. The findings indicate that image-based abuse, surveillance, threats, and harassment interact with pre-existing inequalities. Reforms in Mexico, Argentina, Brazil, Chile, and Ecuador differ in scope and do not establish uniform regional protection. Persistent barriers concern evidence preservation, identification of perpetrators, cooperation with platforms, and institutional stereotypes. Synthetic images create further challenges involving consent, authenticity, and attribution. The review concludes that effective access to justice requires timely protective measures, specialized assistance, survivor participation, and comprehensive reparation. Assessments of state responses should address implementation and their effects on women's safety and continued participation in digital spaces.
