Legal Certainty of Notary Cover Notes in the Registration of Land Rights Transfer

Year: 2026
Type: article
Abstract: This study aims to analyze the legal basis of a notary's authority in issuing cover notes, their evidentiary legal force within the civil procedural law system, and their legal implications for legal certainty in the registration of land rights transfer. This research is normative legal research employing statutory, conceptual, and case approaches. Legal materials were analyzed qualitatively using a descriptive-analytical method. The results indicate that, first, notaries have the authority to issue cover notes as administrative statements related to the execution of their official duties. Second, a cover note functions as documentary evidence that does not possess perfect evidentiary force like an authentic deed, meaning its evidentiary value depends on the judge's assessment. Third, the use of cover notes has implications for legal certainty in the registration of land rights transfers; they provide temporary informational certainty and support the smooth administrative process, yet they do not establish formal legal certainty regarding the status of land rights. Legal certainty remains determined through the land registration process in accordance with statutory regulations. Therefore, cover notes should only be used according to their function as administrative information letters and cannot serve as the basis for the creation of land rights or security rights (hak tanggungan).
