Year: 2026
Type: article
Abstract: The Preamble is the 'philosophy' of the constitution of India. It manifests the desire of the people and establishes values that should be the principles of constitutional institutions. It's assertion of popular sovereignty asserts that the Constitution is the source of constitutional authority. Ideals of Justice, Liberty, Equality and Fraternity are the moral guides for democratic political governance, social change and human dignity. It's not just its role in the introduction. The Preamble helps to clarify constitutional provisions and ambiguity, and reminds the State that its public power needs to be exercised in a way that is consistent with the constitutional goals. In Kesavananda Bharati v. State of Kerala (1973), the Supreme Court decided that the Preamble was part of the Constitution and therefore applied the ideas of the Preamble to the process of determining the Basic Structure of the Constitution. This article examines its development, its status and the role of the judiciary in interpreting and retaining its importance.
