Abstract: The article examines the public-law mechanism for regulating activities in the gambling business in Ukraine. It analyzes the legal, organizational, and managerial foundations of regulating the gambling and lottery market, as well as evaluates the effectiveness of existing state control and supervision instruments. The study reviews key legislative acts governing the functioning of the gambling business, including the Law of Ukraine “On State Regulation of Activities Related to the Organization and Conduct of Gambling,” the Law of Ukraine “On Advertising,” and the Law of Ukraine “On Media.” Legal conflicts and gaps have been identified that complicate effective control over operators’ activities, including the lack of clear criteria for evaluating advertising materials, imperfect mechanisms for determining the media audience’s age categories, and the risk of abuse of penalty sanctions. Particular attention is paid to the institutional mechanisms of state regulation that ensure coordination between the state, market operators, and society. The differentiated goals of the state and business entities are analyzed, which allows assessing the effectiveness of balancing public and economic interests. The study of European experiences in gambling regulation demonstrates three main models: full legalization, partial legalization, and prohibition of gambling, which provides opportunities to adapt institutional and organizational approaches to Ukrainian realities. Specific ways to improve the public-law mechanism are proposed: harmonizing the Law of Ukraine “On Media” with the provisions of the Law “On Advertising,” introducing the possibility to specify age categories in the media registration form, developing open methodological guidelines for gambling advertising, and mandatory prior notification of violations before imposing penalties. It is emphasized that the comprehensive application of legislative, institutional, and preventive measures will enhance transparency, balance, and efficiency of state control, protect citizens’ rights, including minors, and stabilize the gambling market in Ukraine.
