Type: article
Abstract: This study examines the concept of inheritance rights in the Qur’an through the approaches of two figures to be compared, namely Al-Tabari and Amina Wadud. The discussion of inheritance rights is often understood normatively based on what is stated in the verses of faraidh, which distinguish between the shares of men and women. However, the development of interpretive thought as well as contemporary issues requires scholars to present new paradigms that attempt to read the text contextually in accordance with present societal conditions. This research aims to identify the similarities and differences between the two figures in understanding the verses on inheritance distribution, particularly the distribution between men and women 2:1, as well as its implications for the concept of gender justice in the field of interpretation. The method used is library research with a qualitative approach and comparative analysis. The data were obtained from the primary works of both figures as well as supporting works relevant to the research topic. The results of this study indicate that Al-Tabari tends to maintain the normative religious provisions in the distribution of inheritance. Meanwhile, Amina Wadud emphasizes a hermeneutical approach guided by the principle of substantive justice, resulting in a contextual interpretation that takes into account social, economic, and gender roles. This comparison demonstrates that although both figures depart from the same source, namely the Qur’an, the different methodological approaches they employ lead to more varied understandings. Al-Tabari interprets inheritance verses by adhering to normative religious provisions, whereas Amina Wadud leans more toward contextual interpretation in order to achieve the goal of gender equality.
