Plan before Repeal: Urban Land (Ceiling and Regulation) Act, 1976 and the Likely Impact of its Repeal on Urban Development in West Bengal

Year: 2026
Type: article
Abstract: Parliament enacted the Urban Land (Ceiling and Regulation) Act, 1976, to curb the concentration of urban vacant land in private hands, check speculation, and enable equitable redistribution to house the urban poor. Using historical, legislative, comparative, and planning-policy analysis, this paper traces the Act's origins in the land-reform consensus of the 1950s-1970s, its statutory architecture, its two-decade implementation record, and its impact on urban development. The Act classified urban agglomerations into four population-based categories (A-D) with differentiated vacant-land ceilings; in West Bengal, Category A agglomerations such as Kolkata were subject to a ceiling of 500 square metres, while smaller categories faced correspondingly higher limits. Widely criticized for fostering litigation, corruption, and artificial land scarcity, Urban Land (Ceiling and Regulation) Act was repealed nationally in 1999, though West Bengal continued to retain and enforce it for nearly five decades, becoming by 2026 virtually the last major state where the law remained operative. Drawing on legislative and government sources and the documented experience of states that repealed ULCRA earlier, the paper examines the probable consequences of West Bengal's 2026 decision to scrap the Act for land assembly, real estate and industrial investment, urban planning, housing for the poor, and state revenue. It argues that while repeal is likely to ease land assembly and improve investment climate, realising these benefits without reproducing the speculative, environmental, and equity risks observed elsewhere will depend on complementary safeguards including affordable-housing mandates, protection of environmentally sensitive land, and orderly resolution of legacy litigation over already-vested parcels implemented alongside the repeal.
